The incident took place around 9:30 a.m. Friday, Oct. 5 at Dogwood Road in Cortlandt, where police responded to a report of shots fired. State Police, Westchester County Police and Peekskill Police officers all responded.
An investigation determined that John J. Magner III engaged in a dispute with a party known to him at his residence, and fired two rounds from the Marlin .22 rifle.
Magner was charged with first-degree reckless endangerment, third-degree criminal possession of a weapon, both class D felonies, as well as the illegal discharge of a weapon and use of a rifle in a prohibited area, both unclassified misdemeanors.
Magner was arraigned before the Town of Cortlandt Court, and remanded to the Westchester County Jail in lieu of $25,000 cash bail or $50,000 bond. He is due back in court next week.
